In general, you don't need an employee handbook to separate. And the firing manager is not to express any personal opinions about the jobholder or make any remarks that could be misread as discriminatory. Guidelines for an employee termination. As you now know, terminating a jobholder is not as simple as saying "you're fired." It's a legal procedure and is therefore much more complicated that it appears on the surface. During a sacking, you should cover why they will no longer be working at the business. If this is medium-risk termination, you'll normally negotiate a larger severance to make the dismissed employee go away quietly. Although your small business probably has a "name, rank and serial number only" reference policy, probably your managers and workers are giving reference interviews against the policy. For high risk dismissals (where the jobholder will sue and you'll lose), you never "officially" fire the jobholder, so you don't need a notice. But, you wouldn't layoff him for being late 4 days in a row. In this case, you could layoff all personnel with a rating of 4 or 5. If you decide on voluntary dismissals, the process is similar to what you learned in Chapter 10 for high-risk dismissals. In total, there are roughly two dozen laws that protect personnel from being fired. If you do, you will have greater success in protecting the small business from illegal layoff lawsuits.
